The insolvency of the policyholder raises numerous legal questions with regard to life insurance. Since life insurance is an important safeguarding against poverty in old age and is often used as a (financial) protection of surviving relatives, constitutional and socio-political arguments must be taken into consideration. In addition, the involvement of third parties as beneficiaries provokes a complex conflict of interest between the parties involved (creditors, insolvency administrator, insurer, policyholder and third-party beneficiaries) which lies at the interface between insurance law and insolvency law. This article examines the fate of life insurance contracts in the event of the policyholder’s insolvency and shows possible remedies of the parties involved. © Open Access – Licensed under CC BY 4.0 (https://creativecommons.org/licenses/by/4.0).
